My Mom died in California, and her will was probated in Hanford, CA. The lawyer sent a letter the Logan County Recorder with a check to do the mineral rights transfer, so I am surprised there is no deed. What would you suggest as my next step.
There is an old lease from 1982 that Mom did that describes the land as E 1/2 of NE 1/4 of Section 17 17N 4W, so maybe the rights are only limited to only the east side of the quarter section. On my Dad’s farm in Grady county, everyone with mineral rights in a section, whichever quarter, gets royalties. Is it different in Logan County?

Sam the E/2 of NE/4 explains that since the well has a spacing covering the W/2 of the NE/4. On your dads farm in Grady, it sounds like the well itself has a 640 acre spacing. That means the OCC determined it is harvesting the hydrocarbons from the entire section (in that formation). It depends on the well type, depth, and formations encountered. Common spacings are 10, 40, 80, 160, 320, and 640. So you really have to do some homework to determine what applies to your situation. We have wells in the same section that we have different royalty interest in because of the spacing order (or unit size).
The will/probate/deed. I’ll have to get back with you. You may have a mess, but is it something you need to investigate. What was your mothers name(s)
Rick - Thanks for the lead and suggestion I find out what things are now rather than later. The 80 acre spacing is consistent with some of the other documentation I am finding, including a filing on spacing that shows different spacing for different formations.
My Grandmother was Jeanne Lenore Pexton. She lived in Guthrie for many years and wrote poetry that was published weekly in the newspaper. My Dad built a “mother-in-laws” cottage on our farm about 1951 and she moved down to near Chickasha at that time. After a couple of years, she moved to a house in Chickasha where she stayed until she died.
My mother’s maiden name was Wilma Jeanne Pexton. She was the youngest of the five children: Tom, Lawrence, Frank, Mary, and Wilma. All of my uncles and aunt have since died.
To Rick, not sure if you meant to post the comment here. The spacing order filed Mar 19, 2013 (#201302010) for S33-7N-6W in Grady County lists “Known and unknown heirs of Wilma Jeanne Penny” c/o Janet Leitman (my sister) in Palm Desert, CA. I and my sisters (all of the heirs per her will) are also listed on that order. Rick, is this the order you reference? Since all of us are there, how do we go about deleting the reference to Wilma, or is it necessary to clear things up?
Finally, a general question. In the different orders being filed, there some people listed who I know by hearsay to have wrong addresses or be deceased or some other way be listed incorrectly. What should I do, and how do I do it?
Based on what you said, it is possible that you have a clouded title that does not 100% fill the requirements of Oklahoma’s Marketable Title Act. It may not cause issues now, but it could in the future. The lawyer sending a letter and a check to the county is what scares me. I feel it is worth investigating now whether corrected or not. At least you will know what you are facing if something comes up.

Sam I found a Proof of death and Heirship signed by Wilma J. Penny in regard to Mary Pexton dated 4/12/94 and recorded in book 1328,page 353. Also a leased signed by Wilma on same date and in book 1328 , page 349 & 350. My guess is they didn’t clean things up after Mary Pexton passed away. there also was a Lawance H Pexton who signed a lease on 2/14/94 book 1329 page 735.

Regarding the different orders, the law office filing the orders would like to know about addresses. They have to certify that they made a good faith effort to get it correct. I think the depend a lot on the Land Company thought. So, the land office handling the particular matter would like to know also.
Unfortunately, the docs available only go back as far as 1994. Is there any way to find older ones without going there or paying a lot to have someone there do it for you?
I have not yet to figure out how or why wells like Deepwater Horizon could go over 35,000 bod and indeed leaked over that much oil for 87 days, Sadam set fire to 149 wells that each burned off over 50,000 bod for over a hundred days, Alaska wells top 35,000 yet the most any well on the continental USA has ever produced is just a tad over 7,000 bod? I don’t understand all I know about it.

We do have some book & page #s and will call and order. It seems to me that they are confused because of a person interchanging Anne & Anna and from what I think I m piecing together on Ancestry.com she may have been married 4 times! Hopefully, we can straighten it out. I thought I read here and in the info from the landman that we had to show it going through OK probate, but my husband said he just read in Readers Digest that you don’t have to do probate in OK. Do you know if we would have to show a will or go through probate? Thanks! Newbie

Reliability of Readers Digest has always been akin to Huffington Post, the writers just do not check their stastics. Of course, Winston Churchill said in a Missour Speech, “We have 3 kinds of lies today, Lies, Damned Lies, and Stastics.” Very true. But I got the word that Probate is absolutely required in Oklahoma, but not in Missouri. In Texas it is traditionally who has the fastest draw and best shot. LOL I am a good shot depending on what the target is. LOL
Hello All ~ I do not know much about the process of drilling. Tried looking on line and really didn’t get a firm answer. I have a lease with Osage located @ S26 T17N R3W N2 NE. I show activity as flowback. Can someone clairfy what that means?
Marlo, that should mean that the well was drilled, hydraulicly fracked and now they are recovering their fracking fluid. Hopefully they will test the well soon for production.
