I signed a lease in Feb with Antero. In April I received an offer to sell from "Mountain View Minerals” which had it addressed to me and OBO to my Dad who is deceased for 8 years. It went in the trash.
Today my son received the same offer from the same company and it was addressed to him with OBO and my name.
None of my kids are listed on any of the mineral rights/oil/gas leases or county records in WV. They are not listed on anything I own. How did they get my son’s address? He doesn’t live with me nor does his mail come to my house. Isn’t making an offer to someone not entitled to sign anything illegal?
Mineral buying companies gather names in any number of ways, basically however they can, and certainly to various degrees of accuracy. Not to mention lists of names get bought and sold and traded and whatever else can happen in the name of making a buck. It’s a free market - and the only thing worse is - well most everything else.
As for being illegal.. I’d be hard pressed to say that. Casting letters into the wind is kinda like looking for love - it’s done in bulk everyday!

@SylviaG Alot of these companies use interns from universities to research as the interns could be learning how to get into the business. I would call the company and ask them to remove your children from receiving letters. If you own the minerals and you are still living, the kids can’t sell anything or sign anything legal as long as you’re still alive. The letter maybe an intro letter to an offer.
@SylviaG I’d second what FJ is saying - nothing illegal to sending mail out.
As for offers, when it comes to mineral rights, you can Quit Claim purchase anything from anyone. What matters if they actually own it. So if they actually bought it from your son and you own it, then they actually bought nothing.
More than likely, your letter is a soft offer to purchase NOT an actual contract to purchase. If it isnt a legal document describing the actual property and having notarization and signatures sections it really is just a soft offer
