G Win, We did have a pooling order come after Devon drilled a well in Payne County, but they are not supposed to drill before the pooling. I would call OCC and ask them if the pooling order has been allowed. 405-51202613 is the number for mineral owner assistance and they are nice. They can look at the order and see if your name is on it. The completion reports can take several months after the well has been drilled, but may be longer if AEP has coded the well confidential, so you might want to ask the OCC if the well is confidential.
G Win The pooling was recommended 10/7/14 should be any day for Order.
G Win, The first thing you should get is the notice of hearing for the pooling which will come by certified mail, but the actual pooling order itself will come by regular US mail.

Go to Oklahoma Tax Commission http://www.oktax.state.ok.us/
On left side of page, click on Gross Production, then click on Public PUN Search, then scroll down and click on Search by Legal and enter 28 20N 02E and click Search, then scroll down and click on Cedar Grove 28-20N-02E and at top click on Production History. Looks like the bulk of the production started in June 2014 and Devon has 6 months to pay you before you are entitled by OK law to collect 12% on any late payments. I’d wait a week or so for the DO. If you don’t receive it by end of Dec, you might send Devon a polite reminder letter, but check back with forum to get what to ask for in the letter.

I have constantly ck’d the OCC website for PUN details and it has showed production for May & June-nothing since now those 2 figures are gone and it is showing nothing. I talked with Devon last week and they said division orders had gone out but I never rc’d them in fact I have not rc’d anything from Devon in over a year. Can anyone tell me what is going on and should I be taking some sort of action. I know nothing about procedure and have tried to educate myself through this forum

Thanks Martha. I had a call today to lease the 31-18n-3e that I am waiting on the pooling orders from AEP. I was offered 400.00 and 1/5 royalty per acre.
G Win, That is one of the biggest decisions minerals owners have to make on their own. Typically there are 3 different elections (offers) in a pooling order and one of them may be no bonus and 1/4th. Each mineral owner has to decide if they want more up front cash or more royalty interest in the current well and future wells. If you are going to lease instead of wait for the pooling, I advise getting an attorney to help you. The wording of your lease clauses are very important and I recommend personally handing over your lease in exchange for a certified check. An attorney can assist with the lease exchange also.

G Win, I do not lease for anything less than 1/4 royalty. The highest I have been offered in Payne County is $400 and 1/4th.

Are there any options in current day poolings that don’t involve the mineral owner paying for deductions and fees?
Jay, I’ve had some luck in getting operators to accept leases with no deductions in the Exhibit “A”. The larger the interest the better the luck. Also, know the geology of your minerals and negotiate using industry terminology.
Martha, thank you for your reply. Yes I am aware of that. I have an Exhibit A but every time I submit it I either don’t hear back from the leasing broker or they want to change the wording to go the other direction. Any ideas or suggestions? I have been monitoring Pooling orders and it seems like the OCC Pooling orders all have options that include deductions. I would guess if this is the norm coming from the OCC Pooling orders then why should any company approve a good strong Exhibit A without deductions when they can just pool you and force you to accept deductions. G Win, It’s a very good well! I really can’t tell you what to do, but if I had a great well like yours I would try to get 1/4th royalty. Did you tell the OCC man that you had received the notice of pooling, but have not received the pooling order? You need to pick the election (offer) in the pooling order and send it back to the OCC by certified mail with a return receipt. Your US post office will help you do this. You must return the pooling order quickly. You only have 20 calendar days from the receipt of the order. If you don’t return it, the OCC well make the election for you and they do not select the 1/4th royalty.
