Family Mineral Rights - Long Journey Continues

My wife and I moved from Denver, Co to DFW area about three years ago, ostensibly for her job. I'm retired and as long as I get everything on her list done, my time is my own.

About a year ago, my parents, specifically my Mom asked me if I could investigate the families mineral rights. Could you say no to your parents? I cannot.

So, a long process began about a year ago that I'll call 'Phase 1', which was all the leg work and legal work to getting all the families holdings identified and legally/properly in our family name.

After two abstracts, I finally end up contacting the Lea County Probate Judge, who was EXTREMELY nice and very helpful. She explained what needed to be done.

With the Abstracts done, I noticed one thing. There were SEVERAL names on the mineral rights. They were ALL my relatives. None of them are still alive and to the best of my knowledge, none of them have any surviving heirs. Only my Dad and my Mom.

However, the Probate Judge suggested we go back three generations and see about wills and line of heirs.

I got my great grandparents information. My Great Grandfather DID have a will and it said exactly what we thought it would say. IE, all mineral rights went to his two sons. They are both dead. One of his sons (my grandfather) did have two sons (one of which is my Dad) my uncle passed away several years ago.

So, after getting all of the information from Tulsa ($60 worth of certified copies of death certificates and will), it was plain to the Probate judge that all ownership went to the surviving son (my dad).

I now have an updated mineral deed and a 'Letter of Administration' that says that I am the family personal representative. In Texas, the 'Letter of Administration' would be called 'Letter of Testamentary'.

I have been slowly working my way through a large ream of papers (leases & copies of leases mainly) that came from my fathers mother and from my parents. One of the things I did notice is that our family also own mineral rights in both Kansas & Oklahoma - but I will first get the issues resolved in New Mexico first.

It appears we own approximately 1000 acres of mineral rights in SE Lea County. The reason I went this far, is because over the past twenty years or so, my Grandmother had one piece of property leased and a gas well was drilled. It produced from 1993 until 2005. It changed hands once, six years after the well was drilled. In 2005, the second energy company capped the well. My parents had a lease, but no wills were drilled.

So here I am, now starting 'Phase 2', trying to find an energy company that has an interest in getting energy out of the land.

The 'providence' part?

When we moved here, after looking for almost three months, we finally found a place we could both agree on. One of our next door neighbors collects Military Vehicles - I collect MVs. He and his wife have the same name as my wife's sister and BIL. The wife just retired recently from an O&G attorney's office. She worked there a long time.

Phase 2 has just started. I contacted the energy company the family has done business with in the past. Two leases, one gas well. They said they were not interested.

Now I am in the process of attempting to raise the interest of a driller.

I figured that helping my parents may be the actual reason as to why we are here in Texas.

I just wanted to share this. It has been a long and very educational year.

The interesting part is the next door neighbor who worked in the O&G industry had NOTHING good to say about any O&G company representatives. I am beginning to get the idea that she may have spoken the truth.

Time will tell.

Sorry, I just felt a need to vent. It's been a long year. I've learned a lot since I found this site. I have not posted much because I have not had a lot to say. But finally, we are ready to start looking for a driller.

If and when the oil companies/operators/drillers are interested in your minerals they will certainly find you. Until then you may have a long wait. Sounds like you have been busy with your investigation. At least you now know what minerals you have and where they are. In the mean time enjoy your MV's and retirement.

Yeah, not too big on the whole ''waiting a long time".

There are LOTS of energy companies. I have only contacted four. One large and three small. I'll be approaching a lot of others.

I understand there are a lot of drillers overseas that are interested in this area as well as US companies.

Not sure what I'm going to contact first. But the process continues.

We live in Keller. Funny thing is, though I was born in OKC, OK - I was raised a Texan. From the time I was 1 year old until I 'struck out on my own' when I was 25 and moved to Colorado. It is there I met my wife of 34+ years (loong story there) and she is still my rock. Keeps me centered and 'on point' as it were.

Regardless of how this all turns out, I would LOVE to meet you. Perhaps lunch or dinner? We would gladly host you and your family over for a meal. We LOVE to feed people. And depending on the time of the year, one of the things I 'bargained' for with my wife before the move was 'could we have a pool'. WE HAVE A POOL! How kewl is that? We don't use it much, but it gives me great peace of mind just to stare at the water. I'm funny like that.

I hate to admit it, I have NOT had the time to do the DD on either the Oklahoma or Kansas properties yet.

Having said that, a quick glance says Sedgwick & Cowley counties in Kansas - total appears to be approx 153 acres of mineral rights. I have just finished up with New Mexico mineral rights.

Oklahoma will probably be next, as it appears to be about 350 acres of mineral rights in two counties

Followed by Kansas.

I'm an 'analog' kind of guy. One thing at a time.

Congratulations on completing Phase 1. Now make certain that an appropriate document is filed in each county where you know you control mineral rights indicating your current address. Clint is right, the industry will find you when it wants something that you control.

For you to find a set of players interested in each of your parcels, you must find out who is having success in each of your areas and make contact. The "drillers" as you call them, are not waiting for someone to offer up a lease to pursue but have been putting projects of their choosing together for years before they do any exploration. Its a geology and engineering application of the potential for an area not a single lease that absorbs their decisions. It may take many months for a team to put something worthwhile together and get budgeted.

Only then will the land department begin looking for leases. If the company has knowledge of your land availability, you may be contacted sooner. For your purposes, its serendipity. If you don't have your hook in the water nobody will bite. But fishing takes great patience in the oil and gas business.

Location and Geologic knowledge are most valuable to the owner when the offers do come in.

If you think you have that much acreage in Lea county, you may want to contact the Hinkle law firm in Artesia or Roswell. They are very active in the Exploration business. Suzette Johnson is a paralegal there that has worked with most of the significant operators. Similar contacts exist in areas of OK and KS.

In Lea county, I KNOW my address is on file, because of all the probate work, Letter of Administration and the Joint Tenet Mineral Deed (shows my parents, my sister and myself- includes ALL our addresses).

As I go to the four counties (two in OK and two in KS), I will make sure our names and addresses are on file.

The O&G company found us. My land is in Louisiana but it pretty much works the same way. We were contacted in 2010 and now have a large pad and 1 well. We have seen some royalty's but this area in the LSBD is still being proven. I have learned that this business is slow and have patience. They will find you. My land is family land.
