Custer County

I have a very small interest in Section 5, Custer County. Can anyone give me an update

on activity in that section? Would be much appreciated.

Assuming Oklahoma because of your profile. But there are several section 5s in Custer County. We'll need the township and range to help you. "Why" you are asking is always a help also.

You say there are several section 5's? Isn't each county assigned a grid numbered by sections? Only one of each number, I understand. I am in Section 5, Township 13N, Range 20W. Recently received an offer to purchase from Southwest Petroleum Company out of Dallas TX. Such things I just file away. There has previously been interest in drilling in that area, but that seems to have disappeared. I am searching for any current interest in possible lease. What is your interest?

Janet,

There are 28 Section 5's in Custer County, one in each township. In your Section 5, Primary Natural Resources has permitted a horizontal well to the Cleveland formation. It doesn't look like a development well but a wildcat. If it turns out to be a good well, you may have some rights to production sharing. You may want to continue filing purchase offers away until Primary sends you lease options and maybe a division order. Then your actual ownership amount will become very important to a buyer or lessee.

The section is more like a "house number" on your home address. Township and range would be like the "street". Not exactly, but yes there are several section "5s" in each county, about 28 in Custer County.

Here is a map of Custer County.

Only the corner sections (1, 6, 31, and 36) are numbered on the map.

This will explain a bit more

And attached is a complete Township and Range map of Oklahoma.

You were pooled last year. Pooling Order: http://imaging.occeweb.com/AP/Orders/occ5029142.pdf

A permit was applied for in January but I don't see a spud report showing drilling started. Permit: http://imaging.occeweb.com/OG/Well%20Records/1DD1AA80.pdf

Apache currently appears to be leasing in that section. Primary Natural Resources who filed the pooling has also leased since the permit was issued.

I'd say if you played you cards right, you could lease to both Primary and Apache as I would guess Apache would be targeting the Hoxbar which was not a target of Primary.

Opps.... Gary Replied while I was drafting my reply.

Many thanks to both of you. I am a dunce on this subject (hate to admit it). I will try to do some followup.

I am a California transplant girl with very deep Oklahoma roots. I will probably be asking more questions.

Thanks again!

Just ran off all the info you provided. You fellows are GOOD! Are you from the Extension? I will digest what you provided and probably contact Primary - maybe Apache too. Seems something should be happening there.

Janet,

Did you get paid under the pooling order? Notified? And is that a correct address?

"From the Extension" ??? I don't really know what that is.

Rick. No I did not. I understood that nothing materialized. My address is correct.

What I meant by "Extension" was the University Extension office. Sorry to be confusing.

I was surprised to see how quickly you came up with that document.

You should have received a notice when the application was filed. You should also have received the order which would have notified you to make an election. 4 respondents CC the Oklahoma Corporation Commission with their election. And the company paid at least one of those incorrectly.

The pooling order expired the middle of February. If they did not start the well, it is no longer valid.

You do need to follow up on this to ensure you do not get stuck with an 1/8 royalty interest

I searched some archived records I keep and there was a drilling rig on the site from the end of January to early March.

Congratulations you have a new well! However, you need to follow up on the pooling order VERY quickly.

Hopefully you won't have to engage an attorney to get it corrected.

Depending on how many mineral acres you own might impact how you proceed. Disclosure, looking at the pooling order, I'm familiar with the attorneys that handled the pooling. In my opinion, you might be able to get the election corrected without retaining an attorney to represent you. However, limited knowledge of the business could place you in a bad situation you might regret in the future. It might be best to retain someone to assist you.

Again the risk would be relative to your ownership amount. A mistake with a 1/2 Net Mineral Acre would have much less significance as a mistake with 50 NMA.

Gary,

Your thoughts......

Hello again. I went back to my files, and as previously noted - I have a very, very small portion. a 1/6th royalty on 40 acres split between all members of the Sketchley family, including my Mom. Also, with Primary Natural Resources, I elected that 1/5th royalty. Not sure just how that is affecting my current status. If you have any good ideas - they would be appreciated. It does seem that I cannot keep my ear to the ground in California and hear the rumblings going on in Oklahoma. I intend to call Primary on Monday.

"Also, with Primary Natural Resources, I elected that 1/5th royalty"

So you did make an election on the pooling order? Or did you sign a lease? (I don't see a current lease filed)

If you made an election for 1/5 with them you should be ok. Then only those zones are encumbered. Other formations like the Hoxbar are still open to lease. If you signed a lease for 1/5 then you more than likely are held by production for all zones with that lease. (depends on the wording and clauses on the lease)

Yes, I did make that election and sent it 'timely' registered.
From what I understand, they didn't proceed with that site and it is back to farmland. Not sure just what is happening there. Seems like there is 'potential' but who knows when. So - it seems that I am just on hold for now?? Did I do the right thing? Hope so.

I do have other interests in Roger Mills. Been hoping to get someone interested there. Have had interest before, but it has run out and nothing new developed. Any ideas in Roger Mills? My site is the old original post office site - Yes, I am fishing. . . ;-)

Taking 1/5 was likely the best option in your situation.

Section Township and Range would help me way more than old original post office.

OK - Roger Mills - Section 23 - 15N - 21W - I have 80 acres. Lowery Smith, my cousin, owns the land. Minerals are mine.

What is all your interest in this??? Connections??? How did you get to know so much? I do appreciate

your input and response - just want to know who I am talking to.

Thanks again.

Janet,

I'm a primarily a mineral owner. I became took over the management of my grandmothers assets and have since inherited a portion. I manage both immediate family assets that we have a shared interest in as well as assisting my extended family. I've spent the last few years attending NARO conventions and obtaining training from several sources, AAPL, NARO, NADOA, many books, attorney sessions, Landmen, sitting in on OCC hearings and rule making session, spending time with petroleum engineers and geologists, etc. I was also around the business a small amount growing up. I've participated in this forum and others to broaden my knowledge on the subjects that I don't get involved directly with and sharpen my skills. I'm involve deeper than most mineral owners as I work the other side of the business in some ventures. When I first started, I had many questions that I received help on here. So, I try where I can to assist others to pay it back or pay it forward depending on the applicable perspective at the time.

Connections? A few, and the list keeps growing. :)
