MY FAMILY LEASED OUT MINERAL RIGHTS TO BRIGHAM 2009. WE RECEVIED OUR UP FRONT LEASE MONEY.THEN BRIGHAM SOLD OUT TO STAOIL.IN 2013 TRAINGLE USA PERTROLUEM,DRILLED 2 WELLS SECTION 154-100-LITTLE MUDDY 11H AND 13 H.BOTH HAVE BEEN PUMPING OIL SINCE OCT. 2013.WE HAD ALL OF THE PROBATES DONE,SUPPOSEDLY.EACH TIME IT SEEMS LIKE WE ARE GOING TO START GETTING ROYALTY CHECKS,SOME THING NEW COMES UP.NOW THEY SAY,THAT WE HAVE TO REOPEN MY MOM'S PROBATE,THAT WE HAD DONE IN NORTH DAKOTA,FOR BRIGHAM IN 2010.IS THERE ANY ONE OUT THERE THAT CAN SHED LIGHT ON THIS? IT HAS BEEN ALMOST 9 MOMTHS OF DRILLING.I HAVE TALKED TO TRAINGLE ABOUT 3 TIMES,EACH TIME THEY SAY,CHECKS WILL BE SENT OUT SOON,BUT NOTHING YET.I NEED ADVISE AND SOME SORT OF IDEA OF WHAT IS REALLY GOING ON.THANKS

What is the reason given why you have to reopen Mom's probate? Even a typographical error in the legal description could be enough reason why they could demand this.

Also, which state/county are you in? Probate laws vary a lot by state, and practices at the local court vary, too.

Denise, I am not sure of what the problems may be in your mother's estate or why the oil companies want probate reopened, but I have inherited mineral rights in North Dakota, both McKenzie and Williams County and have had to reopen probate on both my mother and my grandmother and am no where near receiving checks yet (it's been 3 years). I did my research and found a substantial amount of money in suspense and being held by North Dakota to be certain that the legal costs will be worth it. The oil companies and the State of North Dakota have demanded this be done. I am dealing primarily with XTO and PetroHunt and getting answers out of either is extremely difficult. I had to become the "squeaky wheel" and drive them crazy in order to get any information at all. The wait has been compounded by the fact that attorneys in North Dakota who do this work are extremely busy. I have a great attorney in ND but I'm far from his primary client and it takes a very long time for anything to be accomplished.

It is my feeling that the oil companies that I am dealing with are skilled in the area of avoiding payment at all cost. They don't return phone calls and are evasive if I do manage to reach someone. When calling the oil company make sure you always get the name of the person you talked to and keep notes on exactly what was said. If this is a new well I would guess that it would be worth you time and money to reopen probate. I wish you luck.

Denise, you need to find out exactly why you need to reopen the probate.

You need to contact the operator and find out their title curative requirements before you do anything.

Yes I believe it will be worth it as Janie said, production is over 183,000 barrels of oil as of April for the two wells combined.

If they have a problem with your title, the only reason I can think of for them not telling you is because they get to keep your money until you cure some title defect and you probably can't do that until they tell you what the defect is.

That first check is going to be a doozy.
