Is it the 12/7/2011the completion date or is it the day it came off the confidential list. We have other acreage tied up with this well. The lease reads: if not more than one year shall elapse between completion or abandonment of one well and the beginning of operations for the reworking of the producing well or drilling of another well.

Kevin, it sounds like you have a one year grace period, continuing operations clause which means if on or before the last day of the primary term of your lease a caterpillar showed up and started building a road, pad, digging a pit or equipment showed up to drill a water well for water to frack a well with, if that activity ever STOPPED, the operator would have 1 year to resume operations, and if the operator does so, it will be considered continuing operations to obtain production. The well information you posted makes me think you are almost certainly held by production, in that spacing. I say, in that spacing because, I can't judge the total intent of your lease without having read all of it. I am going to ask you if your concern is that you are held in a different spacing because of "if not more than one year shall elapse between completion or abandonment of one well and the beginning of operations for the reworking of the producing well or drilling of another well" it would depend on your lease language. If you had multiple spacings which you leased on one lease form, without a pugh clause which would release acres in spacings that have not been drilled and which ongoing operations are not being carried out at the end of the primary term of the lease, then all the acres you leased are held by production from the one producing well. Please let me know if I am on the right track or clarify if you can.

Kevin, I looked back and see where you stated you have a pugh clause. I wonder if you had a continuous drilling clause also? I'm trying to figure out what your concern is since you actually posted the answer yourself to the question you asked. I think there must be another question there somewhere.

My concern was what date do they consider completion date. I thought it was the day it came off the confidential list. I called the guy who leased these sections from me and it appears my year extension comes due this December. The one 1280 spacing has no permits or any activity at all. I am hoping for a release opportunity. I suppose alot can be accomplished in 2 months.
