Background
I have inherited mineral rights and received a lease offer.
Question
What can be done with a lease contract to insure that I do not become involved in a 3rd party lawsuit. I see alot of wording to protect the mining operation and nothing that protects me from liability issues.
Exactly.
You must include in the lease agreement strong hold harmless language, including the right to pick your own council with them to pay for it. Then you need a separate hold harmless for environmental protection.
Daniel,
Their are lots of things that need to be put in your lease, not only in case of a lawsuit, but to make sure you don't pay for expensives that should be paid for by the oil company.
Find a good Oil & Gas attorney (not a general attorney) or someone like Mr. Cotten, a mineral manager to help you. I'm sure they will also be able to help you get a better bonus (money for the lease).
