Texas Inheritance Question

I recently find out that my grandmother had mineral rights in Texas. In 1946 my (step) great father purchased mineral rights then passed away without a will (interstate) in 1953 My grandmother was his only wife and they had no children together but my widowed grandmother had 6 children from a previous marriage. She died in 1984 without a will. The drilling leases show half to be in his name and the other half to be in her name. Does anyone know if the leases should have just been in her name only since he died before her and had no children and they lived in Texas a community property state?

You should be able to find a good Landman in Wichita Falls that can help you

Hi, Chanda!

The attached should help you answer your question.

If by "The drilling leases" you mean leases that a company sent you to sign, it may be that you need to prepare an Affidavit of Heirship on your Grandparents, file it in the County where your interests are located and send a certified copy to the company.

If anyone in your family's history from your Grandfather down to today passed away and left a Will, you may also be required to send them certified copies of the Court proceedings regarding those.

If you need an Attorney, I can suggest a few. Accept my invitation to become A Friend on The Forum and I'll send you their contact information privately.

Hope this helps -

Thank you for your reply & attachments. I am new to the Forum and am not sure how to accept a friend request. Can you recommend an lawyer in the Wichita Falls area?

Chanda -

I don't know of any Attorneys in Wichita Falls, but one of my best Buddies is from there. Let me ask him and get back to you.

As an alternative, there are several very qualified and experienced Attorneys that respond to questions on The Forum. Perhaps one of them has something to add.

Mr. Caldwell, are you in attendance today?

Charles

I texted my Buddy. Will let you know what he says.

In the meantime, if you would like me to look your properties up I can send you what I can on what's happening on the ground. Do you have the legal description of the properties?

Oh, and just sent you the invitation to become A Friend. Just click Yes. When you receive a message from someone who is A Friend, you will receive an email link to it.

My buddy gave me the name of Frank Anderson in Wichita Falls, but I couldn't find him on the State's Bar Association Website. There was a Hank Anderson, but he appears to just be a personal injury Lawyer.

You can go to the State Bar Association's website and search for Attorneys in Wichita Falls:

Or I can recommend Wade Caldwell, who is a frequent contributor to The Forum or Loren Nauss, an Attorney in Houston. Either one of them can help you.
