We are negotiating compensation for a saltwater disposal well on family land, in Divide County. Would anyone be willing to share information about the current per barrel rate of compensation for saltwater disposal (SWD) in Northwestern counties like Divide, Burke, Mackenzie, or Williams? I have found published SWD leases with the State, in close proximity to the family land. The operator’s response was that the state gets paid more than individuals. I note that per barrel compensation currently offered by the operator is 20% lower than some leases recorded more than twenty years ago for wells on state land. I am not familiar with SWD rates in ND. But compensation lower than 20 years ago seems odd. In Texas, I expect to get same rates as State. Oil companies say lots of things. How much negotiating power do you have? Are that alternative locations that oil company can use? Are those owners willing to accept a lower disposal fee? Are you willing to forego the SWD if you do not get what you want? Do you have a strong written agreement?
