Surface waiver for a NM Solar Project

We just received a request for a surface waiver regarding our mineral rights in regard to a solar project. The operator has offered $350 for the waiver. Is this a standard amount?

Thanks,

Lisa Kent

The amount offered depends upon the competition in the area. You probably need to figure out the activity in the area because you do not want to give away the right to have a surface location to reach any minerals that might be productive. If there is no drilling anywhere close by, then you might feel comfortable signing it. If there is drilling, then one would be more cautious. Wise to get an attorney to look at any legal document, but that costs about the same as the waiver price.

Of you want to give the state, county and section, township and range or block, abstract name and numbe and section for TX, then the forum can help with activity.

Thank you! It’s Chavez County, New Mexico, Township 10S Range 25E, SW4 and the W2 and of Lot 3 of Section 18.

At the moment, there are several old well bores and no current production, leasing or permits.
