I’m looking for a good lawyer to help my family with a situation that we have. We have oil and gas minerals but I just found out that my aunt’s husband has been collecting the money for the past several years without our knowledge on minerals that should have been handed down to us as well. The only reason I found this information was because he passed away and I saw my father’s name owing taxes but the address was where he used to live years ago. Unfortunately, this has been going on for a very long time and Antero has apparently never questioned it but I can’t sit back anymore and watch this. I would very much appreciate any assistance someone could provide.
You can observe qualified professionals (often with localized expertise) who provide services to mineral owners right here on The Mineral Rights Forum. You will notice them in 3 different places on the site:
-
in display image ads and text links on site
-
in our Mineral Service Provider Directory in the main navigation bar above. These are arranged by professional discipline.
-
as a Business Member within many conversations throughout the site Look for the blue colored “B” on their picture and blue colored text).
These practitioners are often able to provide specific (and often localized) services that meet your needs.

Lot of info to digest here, but what any attorney is going to ask you first, to save you some time/money, the following info you will need for your first meeting.
How do you know you have minerals? Do you have the probate/deed in hand that proves that, or just what you’ve heard around the dinner table?
You say several years, did your mom, dad, you ever sign a lease around the same time your uncle did?
If your father never signed a lease nor was paid by the company for production, are you sure those aren’t back property taxes covering the same land from when he lived there? It’s hard to believe the oil company would 1099 your dad on money he never received, unless your uncle committed outright fraud at a rather sophisticated level which is a much bigger can of worms.
You will want a West Virginia lawyer. Not necessarily one in Wetzel County, but one who is a good West Virginia oil & gas lawyer.
