I am trying really hard to be patient and i have read many a story on this site where i feel like a whiner but my question i guess is why does the landman send a lease to an individual with an offer for such a dollar amount down as a bonus payment for a lease on a certain amount of acres in a county and wave around amounts which in my situation was much needed and than when you accept in good faith or should i say you want the bonus money or just could plain use it do they all of a sudden become very quiet all of a sudden you dont hear from Mr. Landman any longer in less you call him and he never explained to you the waiting process and when you do finally reach him at his office he is busy and only gives you short answers to your many questions well that landman just made a pile of money off your mineral rights ya i guess im frustrated I want to know whats going on and i cant even get an answer from the landman or should i say i have gotten short and non explaining answers My township is in Richland co Mt twn21N range59E section26 I have approx 6 acres Please any answers or explanations to this slow process would be appr thank you theresa hennen
Ms. Hennen, this is common when they have your mineral rights by lease and you do not have their money. How long has it been since you sent them your lease ? How long was the draft, order of payment or bill of exchange for ? Did you deposit the paying instrument with your bank ? The number of days on the paying instrument are working/banking days and weekends/holidays do not count. I would allow a couple days for the paying instrument to get from your bank to theirs, figure the time as working/banking days, and if the time has expired I would record a statement of non payment, saying that even after the paying instrument has expired your demand for payment was not met and you consider the lease null and void. It may not get you paid and you probably will not be able to lease to someone else but it may rob them of the free use of your mineral rights and give you legal standing in the future. I'm not a lawyer but I have gone through a similar situation. They have clouded your title, it may be time for you to do the same for them. I think sometimes that these landmen and lessees do not see the hurry in paying, thinking you will be happy to be paid whenever they get around to/ feel like it and they already have what they want so what's the hurry ?
