A lease I am negotiating has a Right of First Refusal clause, which I do not want to honor. However, being a novice to oil and gas leases, how do I write a clause in my Exhibit that states that I do not want this in my lease?
I don’t like them either. They unnecessarily tie up your ability to lease in the future.
I strike that clause. It can cause havoc in the future. Many of then have time deadlines on them and if you are on vacation, sick and unable to sign or your heirs don’t know about them in that short time frame, it can be a nuisance.
