We have an abandoned gas well and the equipment that pertains to the well on our land on Section 16 Block 58. We do know that the company that last had the lease is responsible for cleaning the land and plugging the well. I found this our from the lease and a letter to GLO. This lease ended in Sept 2011. According to the lease after 120 days we can consider the equipment ours to dispose of . My question is this: 1. does the current leassee have the right to come in and use this equipment without our permission and 2. do they need to submit a permit to go in and re-work the old gas well. We have been told that a fracking tank has been placed on this land. Our lease runs out on Feb.1, 2015 and is then up for renewal. Also in March of 2012 when we noticed tanks, wellhead etc were all still in place I tried contacting the current company to no avail.
Any thoughts, answers or suggestions would be appreciated.

If the old gas well is still on the Railroad Commission proration schedule in good standing, then they may not need a permit to re-work if the work is simply cleaning out, re-testing etc. My guess is the well is abandoned and could possibly be on the RRC list of orphaned wells. In that case, the current operator needs to “adopt” the well and will need a new permit to work-over. You should give the RRC District 8 office a call and inquire about the well’s status at (432) 684-5581. You will need the API number or gas ID number which should be on the sign posted at the access gate.

John – don’t give up on Patriot; they are one of the more active drillers in Reeves. Currently they have 3 rigs running:
PSL BLK C1 SEC 12
PSL BLK C1 SEC 24
PSL BLK C5 SEC 8
Of the 8 permits requested this year, 5 are in PSL BLK C1, SECs 8, 8, 12, 18, 22, 24
The other 2 are in BLK C5 SEC 8 and BLK C6 SEC 11.
