Recycled Water Pond and Surface Owners

We’ve been approached to have an oil company build a pond on our land for recycled water. My understanding is that when the produced water comes up from the fracked well it will be placed in this pond, then treated by a third party, then used again to frack.

Does anyone know the common structure of these deals for the landowner? Is the landowner paid a) to lease the land and b) any sort of per barrel amount for the water used?

Be sure and get a good surface use attorney to read any contracts. The laws vary by state as to how these sort of contracts are written.
