With the assistance of a local lawyer, I have successfully filed a QCD to transfer mineral rights from my son to the family LLC (I’m the manager). It is not clear to me as to the next step. Do I need to submit the Division Order with the oil company advising them of the transfer or does the oil company send the Division Order to us?
You need to send a copy of the recorded deed to the oil company with a letter about the assignment and change of address. To speed things up, include a W-9 for the LLC and send by email. The oil company will send you a division order.
Ok I have a copy of the recorded Deed… I will create a letter and send it to the oil company along with the W-9. I can’t locate a email for the oil company so plan to call them tomorrow to request it. Thank you!
Also wise to send by certified mail return receipt so that you have a paper trail of who received the documents and what day.
Check the oil company’s owner relations website in case there’s a specific form they want you to use. Also, in Oklahoma you are not required to sign a division order, and it’s to your advantage not to. Elsewhere in this forum M_Barnes has posted a sample letter to use to send back after you get the DO and verify that the interest percentage is given correctly.
Thanks for the info on DO in OK as well as the sample response… unfortunately the oil company does not have a website, so I have to call (already left 2 messages) requesting them to call me about the transfer of mineral rights.

Find the website for whatever office of the state registers corporations to do business in the state. Then do a search for the oil company name. There you should get all of the contact details for the company. M_Barnes probably knows what that office is. If it were in Louisiana, it would be the Secretary of State.
