I was just informed that I had inherited mineral rights from my 3rd great great grandparents from 1908. I found the deed book and page number and have traced my roots. However, it is a mess because my unlces had signed with another company in 2023. I am not sure if they claimed 100% ownership and blatantly disregarded my dads 1/6 ownership of his being the oldest of six boys. I am his only child with no surviving spouse. He did not leave a will because he entrusted his brothers especially the one born after him and they just shunned me. The boys were supposed to split evenly 6 ways so when my dad died it would have went to me. I do not know what to do about any of this. I do not live in Pennsylvania where the minerals are that are wanting to have a well to be built on. They are non surface. I need someone to advise me of how to handle this correctly and the best way possible to protect my dads name sake and my great hreat great grandparents who purchased these to pass on down to thier future generations. I have been researching and it is so complex with multi state jurisdictions involved. My spirit is bekng disrupted at the injustice and betrayal and even though I am righteous angry I do not want it to consume me. I miss my dad and best buddy every moment of the day. I would give anything to hear him laugh, give me a hug and would love nothing more than to make him cry one more time beating him at 2500 rummey. That is not realistic though. So the only thing I am able to do is the right thing and the right thing is to make sure that my dads wishes are honored. If anyone can give me a place to start i would be forever grateful. In Pennsylvania, real property and severed subsurface minerals are governed strictly by the law of the state where the land sits (lex loci rei sitae), regardless of where you or your uncles live. If your father had a valid undivided 1/6 interest, your uncles legally could not sell or convey his share. Even if they signed a lease in 2023 claiming 100% ownership or signing an inaccurate affidavit of heirship, title defects do not erase your inheritance.
1. Pull the 2023 Recorded Documents Before confronting anyone, see exactly what was signed and recorded.
Search the county Recorder of Deeds online portal for the Pennsylvania county where the minerals are located.
Search the grantor index under your uncles’ names and your grandparents’/great-grandparents’ names for documents recorded in 2023.
Pull the actual Oil & Gas Lease, Memorandum of Lease, or any Affidavit of Heirship they filed.
Look at the legal description, the specific percentage of interest claimed, and the exact legal name of the oil and gas operating company.
2. Open an Estate / Obtain Legal Standing Because your father died without a will, you must establish clear legal standing to act on behalf of his estate.
Under Pennsylvania intestacy law, if a decedent has no surviving spouse, 100% of their estate passes to their child.
If your father’s primary estate was opened in another state, you will likely need an ancillary probate/administration opened in the Pennsylvania county where the minerals sit to formally place the Pennsylvania real property into your name.
If no estate was ever opened for him, you will need to petition the Register of Wills to be appointed administrator of his estate.
3. Put the Operating Company on Notice Energy companies hate clouded title and will act quickly to limit their liability.
Contact the Land Department or Division Order Department of the drilling company identified on the 2023 lease.
Notify them in writing that you are the sole heir of your father (the oldest co-tenant), that his 1/6 interest was never leased or conveyed, and that title is contested.
Request that any and all bonus payments and prospective production royalties attributable to the disputed share be placed into escrow / title suspense immediately.
Energy companies will not disburse funds on clouded acreage once they are formally notified of a competing heir, which stops your uncles from pocketing your father’s proceeds while title is resolved.
4. Retain a Pennsylvania Oil & Gas Attorney Do not hire a general out-of-state lawyer for this.
You need an attorney admitted in Pennsylvania who specifically handles oil and gas title curative work, co-tenancy disputes, and quiet title actions.
A Pennsylvania oil and gas attorney will review the 1908 deed, verify the exact chain of title, draft the curative affidavits or deeds, and negotiate directly with the operator.
In many cases, once title is cleared, the operator will present you with your own lease package (including a retroactive bonus payment) or deal with you as an unleased cotenant under Pennsylvania’s statutory rules.
Your uncles only have the power to sign away what they actually owned. Document the paper trail, secure legal standing through your father’s estate, and let Pennsylvania title law do the heavy lifting for you.
I was in a similar situation, so I contacted a Landman in the state where the mineral rights are located. He did some research and put me in contact with an attorney. It was a lot easier that way instead of trying to find all the information on my own. Everything is in my name now.

I am so overwhelmed and grief stricken attempting to negotiate EQT’s lease proposal with all the language that is inserted and I need to be careful of only to continue reading to find out that there is or should be a Quiet Title Action pending. I know that I need to be very careful with this right now legally. I do not have the means to retain an attorney like I desperately need. This is consuming my time and energy and disrupting my peace within my spirit. Any guidance is a blessing and very appreciated.
Contact the recorders office in the county where the mineral rights are located and see if they have a number for a Landman. I started with the recorders office first and they referred me to a Landman who did some research and then referred me to an attorney.
Dont blame your Uncles. I grew up with six brothers and two had shifty wives. One wife took her sick MIL to an attorney for a new Will naming only her and husband. These brothers will welcome you on the deal in memory of your Dad.
It is terrible what some people will do and at the worst and most vulnerable time. I am sorry that your family went through that when unity & family over dollars is all that one needs when losing someone irreplaceable. money does not matter because it does not buy the time back. I do not need my uncles to “let” me in on this deal. I am legally entitled to this and am pursuing this with everything in me so that the lineage for my dads bloodline through our direct bloodchain does not end with his passing. Our great grandparents’ lineage and namesake will continue on through our direct bloodline as was their intention for their future heirs. I will not allow my dad or my greatgranparents wishes to be dishonored or disrespected out of greed or I’ll wishes of any kind. with that being said this is not a forum for any personal advice other outside of the mineral rights themselves. as much as I appreciate your time to respond, it was not needed as well as out of the realm of this post.
