Property drilled on 10 years ago - no payment of any kind

In 2oo3, this property was an oil company that drilled. I only found out last year. I contacted the company and they said they did not owe me any money, Are they suppose to pay and up front cost?

What is the legal description of the property?

Do you own minerals, royalty or surface?

The two previous posts are starters for your discussion but if you have additional historical info about this matter, you should post it as most likely somewhere along the way, some legal matter occurred that altered the situation.

A suggestion ... maybe the Webmaster can develop an "auto response" to "empty" questions like this one. The auto response will request that Sender include the legal description, etc., etc., before the question can be routed for response.

You know I have not been doing this very long and I read my post back and realized it made absolutely no sense. I wrote the post really late. The Legal of the property is Sec 19,TS4N, R2 east of the Indian Base and Meridian in Garvin County. I learned last year that in 2003 there was a well drilled on a portion of the 252.33 acres of the land where I own the mineral rights. My mother had just passed away and I knew the royalties were in my name, but at that time I did not have the deed in my hand, it was in a safe deposit box. My question was - for the company to have drilled on the property would they not have had to pay for a lease or something<

The mineral right information would be on file at the County Clerks office in the County where the minerals are located. I would suggest that you verify first that a successful well was drilled and it wasn't a dry hole. Next, I would learn the particulars on this well (lease name, etc) and contact the Oklahoma Oil and Gas Commission for details on the past production. If you are in the spacing unit for this well and if oil and gas has been sold, you need to contact the operator and if all else fails, an attorney might be your best avenue.

There was a well drilled there that was completed October of 2003. It was plugged in January 2004. The name is the Amber 1-19. Another was drilled in 1982 and was listed as a dry hole. I don’t show any product was sold on either.

Either they considered (you) or your mother a non-owner, already leased, or she should be listed in the order. I do see your name listed.

Also it is a 40 acre spacing well, but it looks like it does fall under a 252 acre tract.

Yes, they would have had to pay bonus consideration to the mineral owner at the time of leasing. Since there was no production, they would not have owed either your mother or you a royalty check. Just checking, but I presume that the Deed in the safety-deposit box WAS filed at the County Courthouse, right?
