Probating a Will in West Virginia

In the process of creating an Heirship Affidavit for Texas mineral rights, I discovered an unprobated will from West Virginia. My Texas attorney said I need to get a referral for a West Virginia estate or probate attorney to discuss the probate options. I contacted the West Virginia Bar Association and was given only one name, but he hasn’t responded. Does anyone know where I should go now for a West Virginia referral?

Maybe I’m misunderstanding, but the most currently dated will is the only one that can be determined as valid, no matter in what state it was written. I assume it was written in West Virginia, so, if the person has passed, you should contact the attorney or the firm of that will in West Virginia or have your own attorney contact them. Whichever will is determined as valid, probated, and Letters of Administration issued, then a move forward with the mineral rights can occur.

Hello, in a recent WV probate, I used JacksonKelly PLLC out of WV. I thought they were pretty fair. Their number is 304-340-1000. Her name was Katie Monroe.

Thank you for responding. The will was written in WV, but the attorney/firm is no longer in existence or has changed and I wasn’t able to connect with them. All I have is the name, Bowles, Reynolds, & Risavi, and an old address in Martinsburg, WV. Berkeley County said it hadn’t even been registered with them, so no probate, no Letters of Administration, nothing to get the ball rolling in TX. At the time, it was a small/nothing estate so there was probably no need for probate. But TX law requires that the will be validated by WV, so that’s what I need to find out how to do and my TX attorney said I need to talk to a WV attorney. That’s where I’m stuck now. But thanks again for taking the time to respond. My search continues!
