Probate in N.Dakota

I’m in the process of signing an O&G lease w/ 18.5% royalty on 63 net acres in N. Dakota. Do I need to get a mineral deed through probate in order to receive royalties? As of now I’m about to execute signing of said lease through an affidavit of heirship. Do I truly need to go through the probate process here?

Since I plan on visiting the area of my minerals next week, any suggestions if I could hasten this probate process by being in the county personally?

In some cases, you can get a lease with just an affidavit, but to get paid you have to have clear title which may need the probate. Contact a ND estate attorney.

You can check the bar association and see who is listed as family law attorneys or find a group that does family and law and oil/gas.

Just curious; did you visit the area as you planned. Did you happen to meet the owner of the land (of the surface) while you were there? My real question is: have you been able to find an oil and gas attorney and if so would you share their name with me?
