Pipeline

I have been contacted about putting a 18" oil pipeline across my northern Logan Co. farm. They have offered $80.00 per rod plus 20.00 to tenant. I declined. Any information about easements would be appreciated.

First do some research in regards to the $/rod in your area. The District Clerk's office might have records regarding this matter. Make sure you address all issues in the easement agreement. Some suggestions would be to limit the term of the easement, say 20yrs., stipulate the # of lines to laid in an easement, specify the width of the easement, example 10 feet allowing 30 feet to lay the line, specify where the line will be laid (close to a fence line or property line would have minimal impact on your property), specify annual rentals in a fixed amount, add a clause in agreement stating if the line goes unused for one year, the line becomes the property of the landowner and upon termination of the easement, an instrument will be filed with the County Clerk regarding this termination. After reading Judon's article, I discovered that Luminant had not only encroached on my property by erecting a gate, but also used the gate and my property to access other tracts that were not described in the original easement agreement.

We allowed a buried oil pipeline easement in SE Lane Co. KS in 2007 with White Cliffs Pipeline with great success. The price then was $20 per rod, but they paid damages, Crop damages to Grantor, Crop damages to Tenant. They put it in very quickly, reseeded, with erosion control measures and within 2 years it was barely visible.

Just get width of R/W, reseeding, erosion control, timing and above damages spelled out. Ours paid up front before any work was done. We had absolutely no problem.

We were just offered $100 per rod for being allowed to put a pipeline through our properrty. I would hold out for that and also have the term of the pipeline easement for 15 to 20 yrs. I am trying to find a copy of an Easement that also protects the land owner.
