Can someone answer this question? In December 2025, I received a division letter from Pine Wave stating my interest had been successfully drilled and completed. Then, at the end of December, I received a change of ownership and payment from Rock Cliff. Do I have to wait to get a revenue check in February? This will be the first payment to cover October and November 2025 production.
Sorry to say but you might be waiting longer than that! Even though royalty payments are 2-3 months behind, once there’s ownership change, there’s chaos in the paperwork portion. It takes a long time for them to figure things out. Rock Cliff Energy was recently bought by TGNR. Maybe not all of Rock Cliff but certainly the part that I’m having to deal with up in Panola County, Texas. If name transfers get messed up then I can guarantee you that it will take 5-6 months because “someone” in charge of transfer has dropped the ball and the gas company will only start to find it when the dust starts to settle. I’m currently living this nightmare. Good luck.
Agreed with DPerson answer with one more twist. At some point, the Oklahoma Corporation Commission let Production Companies Drill wells without establishing Division Orders. Now the wells are in production and the Division Owners title work is not even done. It is my understanding, the OCC laws give the Producton Companies one year to get the Division Order Title work completed, and checks in the mail. Here is my take on that, but I am not sure. So, the Production Companies (And we deal with currently 13 of them, they get the idea they do not have to send out checks for new wells for one year, they get to use that money from sales and do not pay the Royalty Owners for a year. NOW, just recently, that is still going on, but the Oklahoma Legislature passed a law saying the year stands, BUT, the Production Companies have to pay Royalty Owners INTEREST on the slow payments. We how have seven of our newest wells that each month there is ALSO interest added into the check payment, or in three of the wells, separate checks arrvive for the interest. Thank you Oklahoma for putting an end to yet another scam where Production Companies find ways to not pay Royalty Owners.
Let me correct what may be a misunderstanding. Companies will drill wells. They don’t acquire Division Order Title Opinions until after the well is producing. This is not a OCC rule or lack of enforcement. The reason is at least two things. A. The company doesn’t know what elections are made until the pooling is completed. B. If the well is dry, the company doesn’t want to pay for the opinion.
Also, 52 OS 570.10 says that a company must pay revenue within 180 days after the date of first sales.
Except as otherwise provided in this section:
1. Proceeds from the sale of oil or gas production from an oil or gas well shall be paid to persons legally entitled thereto:
a. commencing not later than six (6) months after the date of first sale, and
b. thereafter not later than the last day of the second succeeding month after the end of the month within which such production is sold.
The only problem is me NOT KNOWING when the 1st sale was. I have 5-6 wells that are 6 months old going on 7 and at the end of this month it will be 8. No one at the gas company is acknowledging my emailed questions as to when they will get added onto my portfolio. Just a sad time.
But an absolute thank you for that gas lease lesson. I have HAD some dealings in the past with RockCliff Energy
I would listen to Mrs. Barnes and Mr. Dowd on this as they have the legal training, but as a stand alone northern Royalty Owner, I’ll tell you how I handle this and it has worked for me. When I (Royalty Owner) make contact with a Production Company, the request goes to what I will call “Royalty Relations.” Those folks may or may not be much help, but it has improved greatly in the past 40 years. BUT, when I am inqnored, I write an e-mail that our attoreny puts on his stationary and sends it in. That letter goes to the Legal Department of the Prodduction Company and we get fast answers. The cost for the attorney to do this is $150.00. His long standing Paralegal actually does it. Also, production records for all wells in Oklahoma have been moved from the Corporation Commission Web Site to the Tax Commsiion Web Site. Look up your wells on teh Tax Commission Web Site. The only issue I have found on this transistion is that far back history on old, (Plugged) or Shut In wells, that data has been lost to the website user. If anyone knows of a work around for this, I would appreciate that information. As a Royalty Owner, I keep production records by well(s) ((Latterals)), and section numbers ((legal description)), with production companies noted. I have wells that have not been in production that are still active (AC) but have not produced for some years. As far as I know, for old wells, that can no longer been done. But to answer DPerson’s question, go to the OKLAHOMA TAX COLLECTION web site for production records.
Tim is the attorney. I am the geologist.
Texas has its own site for Production if the question was for Texas originally.
