Payment on Surface Use Agreement and temporary pipeline for fresh water

If I have a surface use agreement and I negotiated a different prices and terms than the other nine owners, and my agreement states “Surface Compensation. Company shall pay to Landowner the following amounts” does the company owe me the full amount or 1/10th of the amount like they are attempting to do?

Also, what is the current UT rate schedule per rod for a temporary above ground pipeline to transport fresh water for a product produced off lease?

Thank you for everyones help.

In general, the negotiated rate is based on 100% ownership and payments are reduced by your fractional interest. So if you own 1/10 of surface, then the payment would be 1/10 X # rods X price per rod. Similar to calculation of your royalty decimal. Of course, this could be affected by the exact written terms of your agreement.
