Thinking of purchasing mineral rights in Colorado. Should they be purchased in my name or in the name of an LLC or a Trust? Any help is appreciated.
In my opinion, I recommend putting them in the name of an LLC. It is cheaper than a trust, limits some liability from yourself as an individual. If you do not own the land (surface), I think having the assets in an LLC is a good decision. If you are more interested in using LLCs, you might research the term “piercing the veil.” I think it really depends on how much mineral acreage you want to acquire and also how much activity is going on or is likely to occur in the near future. The more oil and gas activity taking place, the more inclined I would be to put together a sophisticated LLC or multiple LLCs to limit liability.
