Ownership Inheritance

My husband inherited mineral rights in Texas. He has 3 children from his previous marriage. If something happens to him, who is getting his mineral rights? He did not make wills for beneficiary.

With no will, the State will decide who gets the inherited mineral rights per the state’s “intestate succession” laws. In Texas, I believe these laws dictate that you would receive 1/3 of the mineral rights and his children or their descendants would receive the remaining 2/3.

Encourage him to make a will and clearly state his wishes. Without a will you will have a drawn-out mess to deal with.
