No it's not copyrighted. In the spring of 2008, I borrowed it for my neighborhood group in SE Arlington, TX, with permission from a SW Arlington group who had it crafted by several O&G lawyers. Later, I consulted with other groups in the Arlington area who also used the same lease form.

Knowing a bit more today than I did back then, I would probably change a few things (like FROR on the option clause) but overall, it gives a group a good lease form to start off with.

I was told that it was copyrighted. As to FROR, I am glad that I offered that up as an alternative to an option.

An oil and gas lease is like a marriage. At first.....it's wonderful. And if you have the right spouse (Lessee), it stays that way. If after 3 years, you are no longer satisfied, you can break it off.

My family has minerals in Lubbock County, Tx and we have been approached to lease out the minerals. Would you be willing to email me a copy of the TLMA lease so I can compare it to the terms offered? I just signed a producer 88 lease and I wish I had known what I know now. My question is I have 17.77 net mneral acres with. 22.5% royalties. 22.5% of what? How do I determine what I might earn, say at $100300 per barrel oil.

The old Producer's 88 is quite outdated and as you said, Carol, it very heavily favors the O&G companies. The lease we did was written by a team of lawyers that used it for themselves and it covers all the bases to make it fair for all involved. For instance, the 88 will make you contribute a share of your royalties to pay for transporting the gas to market and misc other expenses related to production and marketing. Our lease gives us 25% royalties with NO costs deducted.

Would this lease also be similar to one in Montana? My brothers and I are just starting negotiation on rights there and are really clueless as to what to ask and what is fair. How do you find out how much others are getting for similar properties?
