Is Oklahoma a race to record state? What date controls ownership of mineral rights, the date on the deed or the date it was recorded?
Date it was recorded as long as there wasnt an affidavit/memo to purchase/lease filed
Oklahoma is a race notice state. The first to record without notice of a conflicting claim. If a grantee records a deed first, but is on notice that the grantor had executed a prior deed, then the prior deed would prevail in title.
