OIl and Gas Leasing in Saline County, IL

Saline County IL - a company has leased our acres for $75 per net mineral acre. We singed a contract in May, they recorded it with the county in June and we have not yet received payment for this lease. Is anyone else having this problem with a company Southern IL? When contacted all I received were excuses saying they had thousands of customers, so I know we are not the only ones not paid. Any advice on next steps.

Who did you sign with? I have heard that one specific company has not been paying.

Hi Patricia,

If they registered your minerals and haven't paid you they have slandered title and you have grounds for suit. If I were you I would contact them and tell them they have slandered your title and if they don't pay you immediately you are going forward with a lawsuit. That might be enough to make them pay. If not, don't make your threat an idle one. Sue them. I believe you'll get your money without going to court, although a lawyer will cost you some money, hopefully not too much.

Thanks so much. What I am going to try first I think - no expense - write a Dear Editor letter to the local newspaper, already contacted a reporter there, I have contacted the BBB to do a report on the company and then I will file a complaint with them, and I will file a complaint with the attorney general in Springfield IL. I thought since we have not received payment and they have already registered my minerals there would be a legal issue as well. I just wasn't sure what it was. The State's Attorney just said it was a civil issue.

I will contact them tomorrow and will let you know how it goes.

This is the long way around but we don't want to spend more money on legal fees than what we have coming in on lease rentals. We didn't have too many acres but enough we want our due. Will call them tomorrow and let you know the response I receive.

I called the company this morning and talked to the secretary of course since the boss is never in and told her our next course of action which she then called threats, and said she had nothing to do with it but it is funny that she is the one who made sure my brother in law was paid for his lease when he called and then said they did not have clear title when I brought up slandered title- if that is the case how could they pay my brother in law- three brothers share in this. She then let me leave the message on voice mail for her boss. So it seems she has an answer for everything at this point. If we don't hear something in the next few days will go ahead with the complaints.

Even though she may not have the authority to make these decisions, she is, as most secretary's/office managers in a position to stop your call at her desk or forward it to whoever can make the decisions. She knew when you mentioned "slandered title" you knew more than the average person and she had better let the boss handle it. I don't remember if you said your draft is due or past due. My minerals were registered about 3 weeks before they were supposed to pay me so they just waited 'til the draft was due to pay me. Too bad you didn't find MRF before you signed away your minerals. I'm thinking you would have gotten more bonus AND royalties. Who knows at this point. I would be willing to bet you hear from the boss before long. Ask enough questions here to prepare for when he does. You need ammunition. I do wish you luck with it.

Draft is past due - it was dated May 4 - void in 60 days. We didn't respond to their first offer of 25.00 net mineral acre. We did get the going rate. In 2005 we leased the mineral rights to Shawnee Resources and it all went as it was supposed to. When we were contacted this time we knew the money was too low and waited them out for a larger offer and Jim's brother was the one who looked into things. He has always been the one with more knowledge in this area and we let him take care of it. When he called and talked to the secretary she immediately looked into things for him and he received payment.

Would you explain slandered title to me in more depth please. Also how would we know if they drilled and started producing gas on our leases? Is there some place to keep tabs of this or can they do it and without us knowing and not pay royalties etc. ? Thus far I am not impressed with their honesty. Is there anything else I need to know that you are aware of?

I really appreciate you taking the time to guide me along here. I do wish I had know MRF existed before all of this took place. But I know now!!!

Next Energy, LLC is Jack F. Overstreet out of Fort Collin's if I remember correctly. I was informed by a landman who was working for Next in that area that he hasn't been paid either. Next owes him $30k.
