My dad and two of his brothers have always received oil checks now me with 5 other siblings have it and my two uncles have passed,no hiers who does their share go to.

It depends on if your uncles left a will. It also depends on the state the property is located and it also depends on the state of probate - and if an estate was opened. Also, the uncles likely have heirs at law - even if they did not have any children.

Mr. Cotten is correct. The biggest factors will be the state that the minerals are located in, if a will was in existence at the time of death, and the surviving heirs (not likely that they did not have heirs - i.e. surviving spouse, children, parents, niece/nephew). My wife passed away last year and owned mineral rights located in North Dakota in both Dunn & Slope Counties. She did not have a will but I am her surviving husband. Do I need to legally re-file for ownership for these mineral rights or do they automatically pass on to me? Also, what kind of timeline is normally put on mineral rights...or are they continually passed on to my survivors?
I would appreciate any of your comments on this matter.
