We have recently inheirited several parcels of mineral rights in North Dakota, we don’t live in North Dakota and have been told by our attorney that we will have to set up a separate probate in that state, does anyone know how I would go about finding an attorney who deals with Mineral Rights issues like this?
I have talked with an attorney located in Plentywood, Montana on several occasions but haven’t used him for specific legal matters. He has always been courteous and appears to be very sharp on Montana/North Dakota oil and gas issues. His name is Mike O’Toole and his phone # is (406) 765-1630. Again, I don’t know anything about his charges for legal representation.
For my brother and I it was more in the line of a simple probate and the Lawyer recorded the deeds for us. It was just the two of us and we agreed to equal shares. All told about 5 months and $1500. If all your minerals are in one county, [ ours weren’t ] you can probably shave a month off that. If the estate was probated elsewhere, it should be even easier. Should be quick and easy as long as everybody already agrees to who owns what. I didn’t enjoy doing it by remote controll with us in TX. and minerals in N.D. I need the same thing. My father died in 2004 and I started attempting to manage my mothers financial affairs. In the past we always received affidavit of heir ship and that seemed sufficient. My goal is to get my father's will probated in ND (5+ counties) and then deed the mineral rights to myself while reserving a life estate so the proceeds go back to my mom while she is still with us.
