A Part of The Charles Massenton Survey, A-289, Marion County, Texas, the same land described in Mineral Deed of record in Volume 133, Page 225 of The Deed Records of Marion County, Texas.
Can someone tell me what my next step is? My Mother passed & left this to me.
Can you be more specific with your mineral location. Marion County is comprised of several oil fields, some to the West of Jefferson, some between Jefferson and Smithland and the largest on the North side of Caddo Lake which is known as the Marion County Shallow, mainly old production. Your best method would be for you or someone you hire, to do some research in the record department at the County Clerk office in Jefferson.
If your Mother had a Will and you can afford about $1,500-$2,000, the typical cost of a Probate, then file the Application for Probate in the probate court where your mother last resided (I believe that in Texas you can file it in the county where she died or owned property as well, even if those are different counties than where she last resided). If your Mother did not have a Will then you could file an Affidavit of Heirship in the County Clerk's Office where the minerals are located. This would put the public on notice that you are the new owner of that property. If you have existing production and Marion County taxes royalty income, or if you don't have existing production but did inherit surface as well, then you would need to provide a certified copy of either Probate or Affidavit of Heirship to the Central Appraisal District so that they could update their records.

Charles,
I couldn't find a detailed description in my Mother's belongings, but I found a letter from a former lease stating something called " The Rodessa Formation ". I believe that narrows it down some. Your suggestion of researching the County Clerk's office in Jefferson should be my first step.
Thank you very much. If you know any specifics regarding "The Rodessa Formation" (if that narrows it down enough), I would appreciate it.

Pete,
My Mother's Will was probated in a different County in Texas and the Probate Attorney gave me a "Special Warranty Deed" stating that 100% of my Mother's Mineral Interests were passed down to me; But, the attorney told me that I would have to take this "Deed" and file it myself and pursue any further avenues. I am guessing that the $3000.00 that I paid him did not cover the work that it would take to narrow down this particular part of her Will.
The Rodessa is one of the prominent production zones for that area. This info does not narrow down a specific areas as the Rodessa zone has been targeted throughout Marion County. Lot's of old vertical wells in the county, not sure about any of the newer production.
