Need Attorney to transfer Oil Royalties after Death per Will

Hello! My Dad passed last month & he left is largest Oil Royalty to me in his Will. In a letter he left in 2016 it states the name & owner#. Apparently I am being told I need attorney to get this transfer done but I have had no luck finding one. I’m a single mom & looking for a reasonably priced attorney. The OR is in Texas in Montague County & my Dad died in Florida in Clay County. I have the death certificate & copy of his Will from the court house. Please advise!

God Bless~Tara

You can observe qualified professionals (often with localized expertise) who provide services to mineral owners right here on The Mineral Rights Forum. You will notice them among 3 different instances on the site:

  • in display image ads and/or brief text messaging on site

  • in our Mineral Service Provider Directory in the main navigation above. These are arranged by professional discipline.

  • as a Business Member participating in many conversations throughout the site (note the blue colored “B” on their picture and blue text on their posts).

These practitioners are often able to provide the specific (and often localized) services that meet your needs.

You need an authenticated copy of the Will, which was admitted to probate by a Florida probate court and an authenticated copy of the order admitting the Will to probate. Both of those documents need to be filed in the real property records in the texas county in which the minerals are located. Then a copy of both of those recorded documents should be sent to the division order division of each company taking production. If such company has other title requirements it will let you know. The foregoing assumes your father was unmarried at death.
