I am dealing with some Texas wells that recently changed operator ownership. The previous operator allowed for a $25 minimum royalty payment via signed division order. The new operator is claiming they have a $100 minimum royalty payment. They have not issued new division orders. Can they change the minimum royalty payment from $25 to $100 without a new division order being signed?
I use the NADOA DO form and return it to the new operator with the $25 minimum. I send it by certified mail, return receipt requested addressed to the Division Order Analyst or Revenue department. I also keep a copy and attach the green receipt to it.
