Minerals Sold For Ten Dollars, What?

I can't find my deed!

My brother and I can't find our deeds.

The person that approached my mentally ill brother was able to meraculously find his deed and get him to sign over everything for ten dollars.

Deed attached.

Someone must know where my deed is or how it is associated.

Any ideas?

Dear Mr. Douglas,

The recitation in the conveyance says "Ten Dollars and other good and valuable consideration..." which is convention in the US. The amount paid your brother would have to be determined another way -- 1099, check copy or stub, receipt of payment, etc.

If you brother is mentally ill, and is found to be non compos mentis by a court of competent jurisdiction, then the validity of the sale has been launched into jeopardy.

I also strongly question the validity of the notarial statement. Without looking at Oklahoma Recoration Requirement, or Title Examination Standards, I am going with a leap of faith that the document is not self proving and not eligible for recordation. Serious issues.

You and your brother may not have a deed into your names. This may be inherited property where no deed into the brothers exists. That does not mean, however, that you do not own the property.

By your brother's sale. you now have a legal description. This happened nearly 15 years ago. It may be worth your while to research activity in that section in Kingfisher County, OK, to see if there is anything worth pursuing. At the least, you can file an affidavit of identity or heirship, or something to let researchers know how the chain of title deraigned into the brothers.

Good evening Mr Cotton,

As a manager you can see my delema, I receive government documents pertaining to horizontal drilling and so forth from Husky Ventures and Payne family Trust and by the way payne corp are far from responding to any sudden information requests if any at all and possibly ever, swings and round a bouts.

Also I receive division orders and cheques, not as of recent, however I haven’t been banking so I have a cheque from Delaware unclimbed funds arriving tomorrow.

I have two different plat maps also.

I can’t even find my mothers original deed in county clerks office.

I will be more than happy to post more documentation for intrest sake and hope I will find the answers soon.

As far as my brother is concerned he unfortunately was so severely mentally impaired and medicated during the process of selling his mineral rights it would have been duress.

My mothers sister, my aunt and my other brother are also included equal portions of intrest in the land.

What a mess!

I don't know anything about mineral rights but I did do some research in Kingfisher. The pdf attachment shows activity in the section/township/range that was on the deed. The dark blue dots is where there is some activity. I am not sure if that falls on your property.

Incidentally, as to your comment quoted below, the "J" in just is not capitalized. "Sayin" is not a word. Neither phrase that you typed qualifies as as a sentence. But, I only have a public education.

Hmmmm! They tracked that guy down way off in New Zealand?

Yes, all three of us brothers in NZ are mineral owners and are in the system somewhere, like any one other people we get division orders, government documents and checks. also I get offers for my minerals from different people too, it’s interesting I can’t locate my deed, however other people know all about me. My last offer was $800 per acre, another letter, some guy two weeks later offering $1000 per acre. I won’t sell without my deed. As far as my brother being told all his minerals were worth ten dollars that is very sad. I believe they flew over to NZ to give him the money and sign the paper. My mother will be turning in her grave over this. No legal document should have been signed by my brother, I can’t talk with him further about his recollections I buried him six years ago.

As long as you get those "we want to buy" letters things are good. Nobody buys useless minerals. Those letters are good omens.
