My husband just got a probate letter in the mail. Is this to give him the land and everything with it, or how does probate work? He has land in Montana and North Dakota with surface and mineral rights. Someone please help us. We are very new to this. We never knew there were properties left to his mom before she passed away 6 years ago. RIP Mom.

If the previous probate was not conducted in North Dakota, you would probably need an ancillary probate in North Dakota to receive royalty, and that would be how I handled North Dakota property. North Dakota does not recognize probates from other states. This is just general advice. You might think about who is doing this probate and what state. I’d want to make the most of the probate process and that would mean probating in North Dakota.
