If my family owns a total of 70 acres and it is divided into (7) 10-acre parcels per each heir and I decide to lease spring water within my 10-acre parcel to a major bottling company would they be entitled to royalties? Mind you we all have separate deeds to each parcel but the spring is on my ten-acre parcel not theirs.
In TEXAS … the water belongs to you, but is subject to the Rule of Capture whenever someone legally drains it from your property … as per Judon Fambrough of the A&M Real Estate Center.
