I need some information on Mineral Rights reverting back to land owner once O & G company leaves land. I have had several people bring this up to me and suggest I research it.. I have been given a name of a company that will do the research, They have qouted a price of 475.00 per day to do research.... Any suggestions or feedback on this topic.... Acreage in Atascosa County La Parita are 223 Acres.
That's a little more than I would bill but in the ball park.
Dear Valentia,
There is very little research to be done. If the conveyance into the surface owner reserved all mineral rights (or previous conveyances in the chain of title), then the odds of you, the surface owner, having a reversionary interest is almost nil. Other states have different rules, but in Texas, unless otherwise provided, minerals reserved are reserved in perpetuity -- which means forever and ever.

In Texas, if the minerals have been severed from the surface, it is very difficult for the mineral rights to revert to the surface owner. You may be thinking of a situation where there is an adverse possession claim of the surface rights. Too complicated to go into in detail in a post like this.
Mineral rights, once severed, rarely return to the surface owner. WHEN they do, you can expect a good landman to find the correct mineral owner!!!
Valentina, I am very familiar with La Parita area and I can look this up for you. Friend request sent...
This might not be a case of a mineral severance in perpetuity. It sounds like it might be a term mineral reservation instead. For example, A sells to B and reserves the minerals and mineral rights for a term of 20 years and as long thereafter as production continues. Once 20 years have passed and any production that commenced within the 20 years has ceased, then the minerals and mineral rights would vest in B and his successors, heirs, and assigns. I recommend that you look at the Deed into you when you bought the property and see if there is something like this in there, where the Seller reserved the minerals for a specified period of time while conveying the surface to you. If it's not there, then look at the prior few deeds in the chain of title going back at least 20 years and look for such a term mineral reservation.
