Mineral rights ownershp question

so my grandma was sherriff sold in 1974 and when i wen over the sherrif sale it only mentions the land nothing about the rights to the minerals so would my grandma still have the mineral rights?

As a general rule, no. In the absence of a mention of any mineral reservation, whatever minerals were attached to the surface passed in the sheriff’s sale. To be sure, an examination of the proceedings must be done to determine what the reason for the intervention was.

i have a copy of our lease with shell oil company and everything. she was colleting royalty up until she was sherrif sold in 74. she may not own them now but would she have owned them back then still?

If someone was paying her royalties they must have believed she owned them. Only a complete review will reveal The Who, what, why & when of the situation.
