Mineral rights on my land

Do i own the mineral rights if i own the land?

It would help to know what state the land is located in, but generally you would only own the mineral rights in land you own if the person you acquired that land from owned the full mineral rights and that prior owner didn’t retain those rights when they transferred title to you.

If you acquired your land by deed the first question is whether that deed included a reservation of mineral interest. If not, you would then need to check any prior deeds in the chain of title to that property to determine if any of the mineral interest was ever separated from the surface ownership of the land through a reservation or sale of mineral interest. In some states, like Louisiana, mineral interest can only be retained for a specific number of years but in others, like Texas, unless the reservation is stated to have a specific time limit it would be permanent.
