I found out that I inherited mineral rights in the state of Colorado. I am a resident of Arizona. I have step-siblings that want a portion of the rights. My question is if the deceased's spouse and any step children are entitled to a portion....or if it is strictly blood relatives. I understand that Arizona is community property state, however wouldn't Colorado law be the jurisdiction since that is where the property is located?
There is a company that has contacted us to lease the rights...I am just questioning how the lease payment and royalties should be divided.
I have no idea about this, so any help is greatly appreciated.
Thank you!!!
If the decedent did not leave a will and there was no probate of the estate, the property will be distributed based on the law of intestate succession of the state where the property is located.
