I just received USB files of my father’s O&G log book and discovered property in Cooke County, Texas, the description is:
1/3 undivided interest in 1/40 mineral interest in the 60 acres out of the Miller Hawson survey, A-587 Cooke County, Texas
Does anyone know what is going on there,? I looked on the Texas Railroad Commission GIS and I see active oil wells, but Texas O&G is foreign to me. Everything I’ve worked with is in Oklahoma.
If i own undivided interest should I be getting royalties from any wells located in that abstract?
When my father died, no probate work was done in Texas, and I don’t know if he did anything about it either when he inherited the royalties. What are my first steps towards finding my ownership, figuring out if the active wells apply to my minerals, and getting the minerals transferred to me?

Texas spacing is different than OK. The description of the 60 acres is critical to which wells you might or might not be part of. I think you might mean the Lawson, M survey that matches that Abstract number.
There are some really old wells in the NE end of the abstract. Mary Voth 1 is still online. XYZ Oil Inc. Probably spaced with a very small spacing since it was drilled in 1948! Your 60 gross acres would have to intersect it. Critical part. If your acres were in the middle of the survey, then might not have any royalties due. The metes and bounds description is needed.
The other active wells are on the SW side. Theo Voth 1 & 2. They are owned by Felderhoff Production.
FIrst check to see if there are any royalties being held a the state using www.missingmoney.com. You will not be able to claim them without a clear title.
Contact the two operators and see if they are holding anything and ask them what they require to get into pay status. They may need a probate or an affidavit of heirship. Be ready with a death certificate, your driver’s license, any other heirs names.
A quick check of the Cooke CAD for property tax assessment may provide some insight. Check for his name over several years. You can also check the Cooke County records on Texasfile.com to see if he ever sold this interest. The operators may have very little information other than who is purchasing from the wells, but that may lead you to an answer. Make sure to check the State of his last residence and the State of Texas Unclaimed Property website for his name. Good luck.
So I just looked on Texasfile.com for the transfer of ownership to my father. The acreage description my father wrote down was incorrect, the actual description is:
1/3 undivided interest in 1/40 mineral interest in 160 acres out of the Miller Lawson Survey abstract 587
160 acres is the actual whole size of abstract 587. Would this mean any active wells on that abstract would definitely include my minerals because of that description being 160 acres?
