I own the mineral rights on a tract of land, signed a lease and received money. I researched and found documentation that a well is in the process of being drilled. How can I know if I will recieve additional income if the well is completed and production begins? I do not own the land, but simply have mineral rights. How is it determined who is included in the division order? I reviewed the Certificate of Pooling Authority P-12, which reflects the individual tracts contained within the pooled unit. It lists several names. Are these the land owners? Would the mineral owners be notified by receiving a division order? Rumor has it in my community that, I am not in the "pool" to receive royalties. How can I know for sure?

The P-12 sets out who's land is included in a certain "Unit" (which lands are pooled for a given well). Beyond that, you may find a Pooling Agreement or Declaration in the County Clerk's Records.
What is your legal description? County, Survey, Acreage? I'll look the area up on DrillingInfo and send you what I find.
The companies are restricted as to how many acres they can include in a given pool. It may be that you're in the "next" well.

You will know if you will receive royalty payments upon receipt of a Division Order, which will specify your exact decimal interest in the Well. Everybody with a monetary interest in the production receives a Division Order. I don't know about the P-12, but usually a Declaration of Pooling Unit will list surface owners' names, yes. IF a Declaration is filed in your County Clerk's records, which is not mandatory unless required in the Lease, then try looking for it by searching for YOUR name as the "Grantee." If you still don't find it, try looking for the Lessee's name (the name of the person to whom you signed the Lease) as the "Grantor." If you still don't find it, there should be a copy of it on the Railroad Commission Web site.
