Is there a difference between a memorandum of oil and gas lease and a memorandum of oil, gas and mineral lease? Thank you
Cookie, I would say that the oil, gas and mineral lease could be construed to be all minerals, including coal, uranium, possibly gypsum or gravel ect. I think it would be wise to strike the word mineral in that sentence.
RW may be correct. Both are just a summary of the actual lease done so they don’t have to record the entire lease and reveal the terms.
Thank you. That is what I thought.
So is an OGML that is limited to hydrocarbons only an oxymoron?
Interesting question. I think it could depend on punctuation and just exactly where the limitation to hydrocarbons only appears.
