Without going into detail here is a short question.
Is it possible for a leasing company to pin down where 1.4 acres of a railroad right of way lays?

It would be possible for a leasing company to pin down the area of a railroad right of way with the approval of the Public Service Commission of ND, who oversees railroad matters including right of ways. I had to look into this matter a couple of years ago so I guess things are still the same.
