Life estate remainderman

My father died without a probated will and we inherited his mineral rights. My mother inherited 1/3 and the children split remaining 2/3. My mother sold her interest which resulted in a life estate. Three of my siblings sold their interest.

My mother passed in 2025 after siblings sold their initial interest. Are they not entitled to remainder share of mother’s interest? Or does it go to company that bought interest prior to her death.

If your mother had a life estate, then that is all she could sell. All remainderman parties would have to join in on the sale for the entire mineral estate to pass to her buyer. It depends on the deed where the siblings conveyed their interest. Texas Caselaw denies the transfer of a future interest, like a remainder in a life estate, without manifest intent. Basically, the deed’s granting language must make it clear that the grantor intended to convey any future interests in the property.
