Land split by highway in Wetzel Co, WV

Good morning…. As many others, i am new leasing mineral rights. The property in question, was split by Veteran’s Hwy, leaving a 1/4 acre on the other side. Should this be treated as two separate parcels? Blockquote

Do you have an opinion about a highway that divides the land but isn’t listed on the lease as a separate parcel?

I called the Wetzel County Clerk, she said the .25 acre probably refers to the sale of land to put the highway through. Would the mineral rights include beneath the highway?

It depends… Sometimes the minerals are kept in one piece and sometimes, the road gets the ROW.

Depend on whether the highway/state/county got a deed including mineral rights or only an easement. If its an easement, in all likelihood, it is one tract and you own the minerals on both sides of the highway and those under the highway. If it is a deed, depends on whether you reserved the minerals.
