Joining two properties for minerals

Can anyone tell me if you own adjoining properties, purchased at different times, own minerals on one and not on the other. Can they be surveyed and a new title as one property so that it gives you more power over the entire piece of land as far as mineral interests ? Thank you in advance.

Once the minerals are separated you can't join them again unless you own 100% and even at that point all you are joining is the surface estate. Historical title will always prevail, even if joined later.

Regarding the survey of the land you own, yes you can have it resurveyed but it does nothing for the minerals. It is only a resurvey of the surface. Mineral ownership title is conducted separately from surface title. Each tract would be written up as separate tracts regardless of they are adjoined and owned by the same person.

On the tract you own minerals, do you own 100%? If so you are in control of that tract surface and minerals. If not then regardless if you own both surface tracts and only a portion of the minerals on the one tract you are subject to any oil and gas lease on either tract. The mineral estate is the dominant estate in Texas.

Most companies will try and work with you regarding surface issues, especially when a small tract. How big is each tract?

Yes we own 100% on one and none on the other.

are you sure you own 100% of the minerals? Some people buy land and are told they are getting 100% but don't and mineral title is never checked in your warranty deed by the title insurance.

If you do own 100% you are in control of leasing and what goes on with that tract. The other tract no so much.

Yes we do, and I knew that meant we controlled that one, just wanted to see if we grouped them if it would help us have more control over the other tract, since we only have surface on it. They were both originally in the same land tract many many years ago. Thank you again for any and all info.
