Intestante Estate: Transfer of Mineral Ownership

I am the sole heir/administrator of my fathers estate. What documents does a TX County courthouse need to transfer mineral ownership from my father into my name? Any help is greatly appreciated! Thank you

Hi, Lee -

Please allow me to offer my sincere condolences for your loss of your father.

I am not an Attorney and you really should consult one for matters like this.

I believe, however, that if the estate is large enough to require an accounting for inheritance tax purposes or something like that, then you will have to go before the Probate Court.

Otherwise, a simple Affidavit of Heirship might be all you need to file of record.

The Texas Probate Code, which you can access through the Texas Legislature's website, has provisions regarding intestate succession. And I am sure that if you were to perform an internet search on "Intestate Succession in Texas" you would find all kinds of reference materials on the subject.

One thing you might need to note are the current provisions regarding surviving spouses, if your father left one.

Hope this helps -
