Inherited Mineralsnand I'm the executor

Hello, I am new here so forgive me if this is a question that’s been discussed. My father just passed and I inherited mineral rights in Oklahoma, I believe Ellis county. I obviously have a ton of questions, but first things first. I live in Florida and my small town lawyer has never delt with this before. Any guidance on transferring mineral rights to a new owner would be appreciated. I’m just trying to make sure nothing gets messed up. Thanks in advance.

In Oklahoma, to get clear/marketable title, you will need to have a probate done in Oklahoma. The probate proceeding will transfer or will memorialize the transfer of the interest of your father to you and any other heirs.

Typically these can be handled without any need for you to travel to Oklahoma or appear for any court hearings. From the date of filing the probate process takes about 55-75 days depending upon court availability.

So sorry for your loss!! Are the minerals deeded separately from surface rights or did you inherit both surface and mineral rights together? Are they under any active leases? This info may be helpful for any others reading to help point you in the right direction. Most likely you will need to go through probate in the county where the land is.
